Civil trial date set for BART shooting

4:45 p.m.SAN FRANCISCO — A federal judge has set a date for a civil trial between the family of an unarmed man and the former BART officer from Napa who is charged with his fatal shooting.

U.S. District Court Judge Marilyn Hall Patel on Monday said the civil trial pitting Oscar Grant’s family against Johannes Mehserle will begin on Oct. 19, 2010 in San Francisco.
Mehserle -- a 2000 graduate of New Technology High School in Napa and later a Napa Valley College Police Academy graduate -- is accused of fatally shooting Grant on an Oakland train station platform on New Year’s Day.

In March, Grant’s mother filed a $50 million wrongful death lawsuit against Mehserle, BART, the transit district’s police chief and two officers.
Five of Grant’s friends and his jailed father have also filed civil rights suits seeking unspecified damages. The judge says she will decide whether to include all three suits in the trial.

" I have followed this phase of this incident also. It is my opinion this civil suit was filed at the behest of attorney's who view this case as a sure fire winner. I hope the whole thing is detected in the trial process. "

" Wow, 50 Million dollars. I somehow feel its all about money now. I am also starting to think about the race card. I believe this was an accidental shooting that may have serious outcomes, (rioting, violence in the street, etc.) if anything less than a full conviction is not made in the criminal trial. This is just a terrible tragedy for all parties. "

" This accident was bound to happen due to the fact that the taser looks and feels almost identical to the cops pistol. Anyone who thinks this was a intentional murder is just being racist towards white men. They think the fact that a black man was killed by a white officer makes it racially motivated.
The Chicago incident where a 16 year old black kid was beatin to death by black kids was never addressed as a black on black crime. It was just adressed as teens kill teen. But with Mehserle it's white cop and black man. Why is race mentioned at all? "

That's completely untrue, especially with the model Mehserle was using. "
