Oscar Grant's friends sue over treatment after BART shooting

10 a.m.SAN FRANCISCO (AP) — Five friends of a 22-year-old man fatally shot in California by a former transit officer are suing the Bay Area Rapid Transit agency, alleging civil rights violations.

In a federal lawsuit filed Tuesday in San Francisco, the five are also suing the agency’s police chief, general manager and the officers involved in the New Year’s Day shooting.
The men say transit officers detained them for several hours when their friend Oscar Grant was killed. Grant was unarmed when he was shot on an Oakland train station platform.

Johannes Mehserle -- a 2000 graduate of New Technology High School in Napa and later a graduate of the Napa Valley College Police Academy -- has pleaded not guilty to Grant’s murder. Mehserle’s attorney says his client intended to pull his Taser instead of his handgun.
They are seeking unspecified damages.

" Just curious if any of the innocent passengers on BART could sue these 5 guys for the danger and emotional stress they caused by fighting and putting innocent lives in danger? Any lawyers out there that can answer this? "

I'm sure they'll be impressed with the coordinated cohesive behaviour of the people who fighting on the train which caused the police to be called in the first place......

Haas anyone heard about the kid who was caught running from that train with a firearm yet ? "

" I agree with the silliness of the suit on its face, but the cops have to follow laws too.

If they had no valid reason to detain the group, then their civil rights were violated. That's what the lawsuit is about. A judge can decide the merits of the case, and a jury an award if it ever gets that far.

I recall how the San Francisco Zoo had to pay the two punks who were attacked by a tiger after teasing it. Odd, how our system assigns blame sometimes. "

" Well, none of them were charged for any crimes. So that's sort of interesting.

And I doubt that any lawyers are "jumping for a chance at this lawsuit" considering that they're represented by the same guy who represents the victim's mother in her lawsuit.

But I'm not sure how far this one could go. We'll just have to see what the true facts are, I suppose... "
