10:45 a.m.OAKLAND — A hearing will stretch into a fourth day as the attorney for a former transit officer charged in the killing of an unarmed man seeks to get the trial moved out of the area.

During Thursday’s session, Alameda County prosecutor David Stein told Superior Court Judge Morris Jacobson that some of the questions in a survey of potential jurors were worded to give results that would favor defendant Johannes Mehserle.
Mehserle’s attorney, Michael Rains, countered by arguing that the survey of about 400 potential jurors was credible and reliable.

The 27-year-old Mehserle, a 2000 graduate of New Technology High School in Napa and also a graduate of the Napa Valley College Police Academy -- is charged with the shooting of 22-year-old Oscar Grant at a Bay Area Rapid Transit station on New Year’s Day.
He has pleaded not guilty in the case.

" The news keeps showing the smiling face of Grant; why not publicize his rap sheet and mug shots once in a while to even things up just a little? Mehserle will never get a fair trial. "

" Grant didn't shoot and kill an unarmed man in the back. Not all the blame should be put on the officer, we need to look at training. Most every kid and almost all adults in Napa are afraid of blacks. This town raises you that way, always has. "
