5:45 p.m.OAKLAND — Testimony will continue for a second day as the attorney for the former BART officer charged in the killing of an unarmed man seeks a change of venue.

Michael Rains told an Alameda County judge Tuesday that the murder trial for his client, Johannes Mehserle, should be moved out of the county.
Mehserle -- a 2000 graduate of New Technology High School in Napa and the Napa Valley College Police Academy -- is charged with the shooting of 22-year-old Oscar Grant at a Bay Area Rapid Transit station on New Year’s Day.

Craig New, a jury consultant hired by the defense, testified that the coverage of the shooting should be grounds for a change of venue. He also cited a survey that found more than 96 percent of 400 residents surveyed knew details about the case.
New is expected back on the stand when testimony resumes Wednesday.

Mehserle has pleaded not guilty in the case.

" It's not frivolous to request a venue change, I will say that.

But considering the media coverage, Youtube videos, etc., how can another county's jury pool not be as equally informed? And if venue is changed, the media will report it and the jury pool will become equally as aware as the potential Alameda County jurors...

So I see your point about the ongoing lynch-fest, Baraki. However, Mehserle was the one who was videotaped pulling out his gun and shooting the victim.* Well, we'll see how it goes, I guess.

" I hear what you're saying Feasor -- but think there's a possibility some other county will be less biased than Alameda / Contra Costa areas? :) Perhaps a county that BART doesn't go to would be appropriate. Either way, Oakland's not the jury pool for this trial... "
