Calistoga murder suspect's hearing delayed

6 p.m.A judge delayed a hearing to determine whether a man accused of a Calistoga murder and a rape that followed will go to trial for the crimes.
Napa resident Rodolfo Rivera Uribe, 23, is accused of killing Calistoga resident Luis Octavio Carrillo, who was dating Uribe’s ex-girlfriend.
The woman witnessed the shooting, and police say Uribe went on to rape her.
Uribe is charged with murder, battery, forcible rape, being a felon in possession of a firearm, unlawfully possessing a firearm and being in possession of an assault weapon.
The delay of Uribe’s preliminary hearing was at the request of Uribe’s defense attorney, Jim McEntee.
McEntee asked for more time so he, the defense investigator and the defense pathologist could review the hundreds of pages of interviews and dozens of media discs containing surveillance videos and photos he recently received related to the case.
He is also awaiting an autopsy report on Carrillo.
Napa Superior Court Judge Stephen Kroyer rescheduled the hearing for 8:30 a.m. Nov. 6 in Department E. He set a pre-preliminary hearing for 8:30 a.m. Nov. 5 in the same location.
Kroyer also granted a request by Deputy District Attorney Michelle Rollins to videotape the woman’s testimony during the preliminary hearing.
The case centers around the June 29 shooting. At about 1:30 a.m., Uribe’s ex-girlfriend, with whom he has a 6-year-old child from their 8-year relationship, was sitting in her car with Carrillo on the 1400 block of North Oak Street.
Uribe approached the passenger side, where Carrillo was sitting, and fired two shots through the passenger window, court documents say.
He opened the passenger-side door, pulled Carrillo out of the car and told the woman to leave. He followed her as she drove away and ordered her via cell phone to drive to Santa Rosa, she told investigators.
He then had her leave her car in a remote area and drove her back to Napa. During the ride, he questioned her about her relationship with Carrillo, slapping her when he thought she lied, court documents say.
When they got back to Napa, he asked her to have sex with him, and she complied out of fear, she told investigators.
Uribe remains in the Napa County Department of Corrections where he is held without bail.

There are to many case's in Napa that are being railroaded into trail, this one is the exception ?
McEntee asked Napa Superior Court Judge Stephen Kroyer for more time and receives six weeks ?
This is why are court system is going bankrupt, to much power in one mans hands.
Kroyer should step down, let a more experienced Judge take his place and move on with this open and shut case. "
