Napa County Superior Court records show Rodolfo Uribe, accused of shooting a Calistoga man last month, has been convicted of numerous crimes in Napa County. Date listed is date of offense, not date of conviction or beginning of jail sentence.

Dec. 31, 2003
Arrested for suspected a hit-and-run. Pleaded no contest, sentenced to probation, two days in jail.

March 5, 2004
Arrested for suspected assault with a deadly weapon, gang activity, false imprisonment after gang-related violence at Jefferson Food Mart in Napa in which Uribe was believed to have held a man while others struck the man.  Pled no contest to aiding and abetting. Sentenced to 90 days in jail, three years probation.

March 31, 2004
Arrested for domestic violence, accused of slapping and choking his girlfriend. Sentenced to 15 days in jail, probation, anger management program.

April 6, 2006

Arrested for possession of a deadly weapon, violation of probation. Police search of vehicle in which Uribe is a passenger reveals brass knuckles under Uribe’s seat. Charges dismissed.

May 7, 2006

Arrested for assault with a deadly weapon, violation of probation. Driving near Pueblo Avenue and Jefferson Street, Uribe gets out of car and confronts a woman. Using a golf club, he sought to strike her, then did strike a man who came to her defense. Pleads no contest to fighting in public. Sentenced to 75 days of jail time and ordered to pay fines.

May 27, 2006

Arrested for marijuana possession. Charge dismissed.

May 27, 2007

Arrested for domestic violence, accused of putting girlfriend in headlock, pulling her hair. Pled no contest. Sentenced to probation.

June 10, 2007

Arrested for assault with a deadly weapon, gang participation. Charges dismissed.

June 17, 2008

Arrested for mayhem and gang enhancement. Gang fight near Solano Avenue bar. Charges dismissed.

June 25, 2009

Arrested for murder of Luis Carrillo, kidnapping and rape of his former girlfriend. Preliminary hearing set for Sept. 9.

" If our courts were tougher with a repeat criminal like this guy, he would not have been able to kidnap, Rape or Murder. He got sentenced to 90 days in jail and 3 years probation but was able to commit another violent crime less than 30 days latter and only get 15 days in jail and anger management. I guess the anger management course really worked. "

" It's amazing the extent of these charges. Ten in all and the culmating result is the loss of life. Given this man's history and it sounds like he was in a gang the abuse continued for years. I thought they had a gang task force in Napa? Obviously this man took no accountability for his actions and would just serve short term sentences to amend the condition and then continue on with his violent acts. Maybe he is from a violent background but most of the time this behavior is learned. Too bad early intervention couldn't of been attempted and now with them letting all the prisoners out early more of this stuff will occur much like this man who serve short spans for misdemeanor crimes. What's the solution to this? "

It is pretty clear he was deep in the gang life, just plead no contest and you get a few days in jail and some probation....not so bad. "

This makes me wonder how many other people are on our streets. could someone please explain to me why he has gotten away with violent offenses for so long with a only a slap on the hand. It seems to that slap was mis interpreted as a high five rather than a punishment.Interventions could have helped this guy out rather than short stints in jail and continued probation, obviously this was not working. " Uribe has been on a six year assault on this area starting his senior year in high school but still, the judges kept dismissing his cases. This is a horrible failure of our local justice system. The Tally:

- 10 arrests in total
- 4 jail terms totalling 182 days (probably served 122 days in all.
- 4 cases dismissed!
- 1 probation
- 1 pending

Out of the 9 closed cases, 4 dismissals. That's a 44.4% victory rate for the defense, not bad. I wonder who is attorney was? "

" UNBELIEVABLE that this animal was given a free pass to go right back out there to do whatever crime he pleases, on way more than one occasion!! Wow! I hope this sparks an utter outrage against our broken justice system. Reading this article, the longest he ever was sentenced to prison was 90 days. For 9 crimes (not including the accusation for murder)!! All I see is charges dismissed, charges dismissed, charges dismissed. Why?! Is this the same judge hearing his case over and over again? If it is, there ought to be a probe launched into this judge. But I doubt it. I think this likely represents our justice system as a whole. And yet, those convicted of petty crimes sometimes rot in prison longer than 90 days. Am I the only one downright angered by this long list of crimes resulting in getting off free or at worst, a stand in the corner for 5 minutes?? "

" Having supported the current DA for many years, I find this troubling. I think Gary Lieberstein needs to stand up and address the history of this individual and why he was not put away a long time ago.

Also, maybe we need to review the anger management process, as it clearly did not work with this individual.

" Joe, maybe innocent until proven guilty is the usual way to go, but you have to admit his history doesn't paint a nice picture of this guy. He's a monster with a proven track record. He has absolutely no regard for human life and it is proven 100% that he has no regard for the laws or human life. Sure, there may be a sliver of a chance he didn't commit murder, but so far, the evidence points that he did. I think everyone commenting here except you, would be shocked if he were found innocent. Our jails are already stuffed with Uribe type citizens (or non-citizens.)

It would seem that we need some more selective judgements made on individuals of this type. They are indeed extremely dangerous out in society as they have absolutely no respect for law or others.

I agree with jbmom, we need to release the 'Martha Stewarts' and keep guys like this in prison away from harming an innocent public. "

The Register needs to do a follow-up story on WHY all the charges against Mr. Uribe were thrown out. Is the problem poor police work? Lenient judges? Lack of interests on the part of the District Attorney's office?

It would seem that Mr. Uribe is the type of career criminal for which the three strikes law was passed. Yet for some reason, he kept getting off on felony charges on his "third" strike. What's the story here?

One thing that's very striking is how he had repeat domestic violence offenses. This is a real indication that some of our local judges don't get how important it is to take these cases seriously. "Anger management" classes? How about "Rot in Jail" classes after your second domestic violence conviction. "
