Judge likely won’t grant Prop. 8 injunction

4 p.m.SAN FRANCISCO — A federal judge in San Francisco says he’s disinclined to suspend California’s voter-approved ban on same-sex marriage while a lawsuit challenging it proceeds in his court.

In a tentative ruling Tuesday, U.S. District Court Chief Judge Vaughn Walker said he’d rather move directly to a speedy trial on the case’s merits than grant a preliminary injunction that would temporarily allow gay nuptials.
A hearing on the injunction had been scheduled for Thursday.

Walker is proposing using the time instead for setting a trial schedule.
Both California Attorney General Jerry Brown and Governor Arnold Schwarzenegger have argued against suspending Proposition 8, saying that it would create unnecessary confusion for same-sex couples.

Even for SF courts to do something reasonable... "

" Judge Walker is right. We need a speedy trial so this can get to the US Supreme Court before B.O. has a chance to install more liberal justices. I like what they did with the white firefighters case yesterday. "

No need. "

Well, the gay activists will just keep appealing until it gets to that level. The Supremes would at least have to refuse to hear the case. "

" don't get your hopes on on a refusal to hear by the supremes; scalia in his dissent on lawrence v texas said that L vs T could be used to invalidate bans on same sex marriage...so the conservatives like him may want to hear the case. "

" Sounds like more waste of tax dollars for an issue that has already been decided TWICE by the voters!
