BART officer: Grant was uncooperative before death

OAKLAND — A BART officer says an unarmed black man who was fatally shot by another officer failed to comply with her commands before he was killed.

BART Officer Marysol Domenici testified Tuesday during the fourth day of a hearing to determine whether former Officer Johannes Mehserle will stand trial for murder in the death of Oscar Grant.

The 22-year-old Grant was killed at an Oakland BART station in the early morning of New Year’s Day.

Domenici says Grant and his friends would not listen to her as she repeatedly told them to sit down on a train station platform moments before Mehserle shot and killed Grant.

Mehserle’s lawyer Michael Rains says his client intended to use his stun gun and didn’t intend to shoot Grant.

Mehserle grew up in Napa, attending New Technology High School and the Napa Valley College Police Academy.
