BART officer murder case delayed

11:30 a.m.OAKLAND — The case against a BART police officer accused of murdering an unarmed man has been postponed following the unrelated killings of three Oakland police officers.

Alameda County Superior Court Judge C. Don Clay on Monday delayed the scheduled preliminary hearing for former Bay Area Rapid Transit Officer Johannes Mehserle, who grew up in Napa.
Mehserle, a 2000 graduate of New Technology High School in Napa and a 2006 graduate of the Napa Valley College Police Academy, has pleaded not guilty to murdering 22-year-old Oscar Grant, who was fatally shot at an Oakland BART station early New Year’s Day.

Clay cited the slayings of the officers Saturday in pushing back the hearing until May 18.
Tension between police and the community has risen steadily since Grant’s shooting.

Grant’s family said they were not pleased with the delay.

" I would think that the Bart Officer would not want to waive time in this trial. It would make the DA put a case together. In face, if everyone in the system didn't wave time, a lot of cases wouldn't be able to be prosecuted.

Lets get on with the case. I'm sure the bart officer won't be convicted of murder "

To wait til people stop sympathizing with the police, til they start to forget that the police encounter murderous thugs on the street that will shoot them and have to be on their gaurd and in a state of high tension all the time???

To make sure that the jury is as prejudiced against Mehserle as possible and doesn't get carried away with the realization that he acted in the day to day highly volatile and dangerous circumstances that Oakland carries for police?

AP could have at least given the reason why the family objected to the delay.

" Well, well napablogger, you might want to look into spell check. Anyway, if the police, any police are so weak minded that they see a monster behind every door, then maybe they are in the wrong line of work. Police are mostly trained professionals whose odds of getting shot on the job are slim to none. What they probably need is an adjustment in their training regimen. Oakland officers are not drafted into serving in that town, and I am sure that they are not naive enough to think that it will be a cake walk. Assumed risk. That they have the onions to work in that environment reflects on their machisimo, masochism, or sincere desire to help the public at large. Take the emotion out of it. That is likely how the second two officers were killed. Regarding your last query, who are Black leaders, who are the white leaders, who are the Hispanic leaders? As long as people think in absolute terms, then they will continue to be blinded by their own prejudices. Please step away from the citrus! "

What difference does it make to the court? What possible reason could exist for a judge to delay this trial in the aftermath of what happened on Saturday?

It's just so sad that we have to live in a world where such things happen, with no valid reason or explanation. It's a real travesty with no logical basis whatsoever.

Who can prove otherwise? "
