October 2009 DUI Report

NapaValleyRegister.com publishes monthly statistics on arrests and convictions for driving under the influence — and so-called “wet reckless” convictions — in Napa County.

Arrest information is from the Napa County Sheriff’s Department. Convictions, names and blood-alcohol levels are from Napa County Superior Court.

Convictions include cases in which the person pleaded guilty or no contest to one or more drunk driving charges, or where one or more such charges resulted in a guilty verdict at trial.

Vehicle code violations considered are: driving under the influence (Vehicle Code section 23152), reckless driving while under the influence (23103.5) and causing injury to another while driving while under the influence (23153).

The blood-alcohol levels provided by the court are based on a variety of tests — some taken at the scene of the arrest or county jail, others through a later blood test — and have not necessarily been proven or admitted in court. It is unlawful for any person to operate a vehicle if that person has a blood-alcohol level of .08 or more, according to the California Vehicle Code.

" I truly look forward to this report each month... just a reminder of how extra careful I have to be while driving to compensate because people like this!

Also, wouldn't it make more sense to use a $100 million grant in order to catch drunk drivers rather than people not wearing seatbelts??? "

" About 2 years ago someone was displaying their key chain breathalizer at a party...I think it was about $50 at that time. Something to look in to for the long run, but when in doubt --- cab it or call a family/friend for a ride! :) "

" Actually, there have been several university studies done showing that the source code ratios used in breathalyzers currently in place in law enforcement agencies are incorrect and deliberately peg the reading at a higher number than is present in the individual. We are now in a zero tolerance society, which means that law enforcement will do whatever it takes to remove drivers from the road who test positive for alcohol. Some of these people’s readings are most likely lower on those who opted for the breathalyzer instead of a blood test. There are so many variables on the breathalyzer test that it is virtually impossible to get a correct reading. Two lessons’ here: 1.Always opt for a blood test, never blow and 2.Never get in your vehicle to drive after taking even one drink. If you take one drink and happen to be waiting at a stop light and someone rear end’s you, law enforcement will cite you for DUI if you blow any number. Bottom line, don’t drink at all. Happy Holidays to all "

I did the DUI thing,got my name in the paper, did the classes, paid the fee, and learned my lesson.
its not that difficult to play by the rules people, it just more expensive. "

" As far as I'm concerned, the longer you wait to post the list the more credible the NVR appears.

But I'm sure the rush to be tabloidish will trump the desire to be credible.

I say, take your time. So far, the list has done more harm than good. Innocent people have suffered severely and the list has done NOTHING to curtail drunk driving. And The National Enquirer still has more circulation than the NapaVal Enquirer. "
