Gang murder defendants in court Wednesday morning

3:30 p.m.Four of the men accused in the gang-related murder of Ricardo Gonzalez last year are due in court Wednesday morning for arraignment.
Stephen Barrios, Raymond Almodobar, Christian Gallegos and Daniel Ortega are charged with the Dec. 8, 2007 death of Gonzalez in a gang fight in the 2500 block of Laurel Street in Napa. The men are being held in Napa County jail on bail ranging from $5 million to $3 million. If found guilty, Barrios, Almodobar, Gallegos and Ortega face 25 years to life in state prison.
An arrest warrant has been issued by the district attorney’s office for 23-year-old Jamie Gonzalez Pena Jr, charging him with murder, but Pena remains at large.
Barrios, is serving a two-year sentence for felony vandalism at the California Department of Corrections in Tehachapi. Barrios was arrested on Dec. 10 in connection with an earlier gang fight at the Collier Boulevard Apartments in west Napa. He was convicted of felony vandalism, fighting and disturbing the peace. He was sentenced to state prison in January. He has been transferred to Napa for arraignment.
Gonzalez,19, was to attend a quinceañera — a birthday party that signals a girl’s coming of age in the Latino cultures — the night of the shooting. He decided not to go at the last minute, according to his mother, Rosa Vargas.
The party drew members of the girl’s family, friends and also a gang element that would cross paths with Gonzalez later in the evening. After the party, Vargas said that a group of Sureño gang members came to her Riverside-area home, and her son left with them.
The gangsters drove to a Collier Boulevard Apartment complex, known in gang circles as Barrio Laurel South, to confront rival gang members. Gonzalez was shot in the head at the site.
Gonzalez, 19, who was married and whose wife Nilda was to give birth to their first child shortly thereafter, died two days after the shooting at Santa Rosa Memorial Hospital.
The men each will be represented by their own court-appointed defense attorney.
The defendants are expected to enter pleas Wednesday. The judge will set a date for the preliminary hearings where the court will decide, after hearing evidence from the prosecution and the defense, if the four defendants should be held to answer to the criminal charges filed against them.
“As it stands right now, all four defendants are charged in one complaint,” Napa County Chief Deputy District Attorney John Goold said. “When the case goes to the preliminary hearings, all four of them will be in the same courtroom with their separate attorneys.”
Goold said if the court finds the men should answer to the criminal charges, "we would then have to work out the logistics of a possible jury trial,” Goold said.
Goold said there is the possibility each defendant could have his own jury. “We would also have to decide if we would have more than one judge presiding over the proceedings.”
The last time the Napa County courts were faced with this type of a logistic problem was in the 1998 gang drive-by fatal shooting of Norteno gang member Michael Arreguin.
Four rival Sureno gang members were charged with his death and the case went to trial with multiple juries.
The four young men were found guilty of Arreguin’s death and are serving lengthy sentences in state prison.
