Correction includedThe fifth defendant in a fatal Napa shooting last December appeared in court on Wednesday for his arraignment.
Stephen Russell Barrios, 19, is charged with the Dec. 8, 2007 death of Ricardo Gonzalez in a gang fight in the 2500 block of Laurel Street.
Barrios, who is serving a two-year sentence for felony vandalism at the California Department of Corrections in Tehachapi, was transferred to Napa County jail this week for prosecution in the Gonzalez murder. He is being held on $5 million bail. His arraignment was continued to Oct. 24, which will coincide with the arraignments of three of the other defendants — Raymond Almodobar, 18, Christian Gallegos, 18, and Daniel Ortega, 19 — who also have been charged with the murder of Gonzalez.
An arrest warrant has been issued by the district attorney’s office for 23-year-old Jamie Gonzalez Pena Jr, charging him with murder, but as of Thursday, Pena was still at large.
Barrios was arrested on Dec. 10 in connection with an earlier gang fight at the Collier Boulevard Apartments in west Napa.
He was convicted of felony vandalism, fighting and disturbing the peace. He was sentenced to state prison in January.
In that incident on Nov. 23, a group of gang members went to the Collier Boulevard apartment complex in attempt to find the rival gang member who beat up Barrios’ brother earlier that day. The group was jumping on cars and breaking mirrors they believed belonged to the rival gang members, who confronted them. When the visiting gang members fled, Barrios was shot.
At Wednesday’s court hearing, Napa County Superior Court Judge Rodney Stone appointed Napa attorney Mike Keeley to defend Barrios.
Dressed in jail house blues, Barrios talked to Keeley through the glass partition. Barrios’ mother sat in the second row in the courtroom audience.
“He’s innocent. He didn’t know what was going on,” she told the Register, referring to Gonzalez’s death.
If found guilty of the charges, Barrios and the defendants are looking at a life sentence in state prison.
Correction: An earlier version of this article inaccurately indicated Pena Jr. had been arrested and was facing an Oct. 24 arraignment.

It's the 'honor among theives' code that seems to cause these sweeps. But, to be honest, if these are gangsters I'm glad they're all off the street. "

One more thing...did you know that Jaime was Ricardos cousin??...how sad that 2 stupid colors are more powerful that blood!!! "

FreeBarrios / 49er, it is clear you know these gang members so why will they not tell the complete truth? Is it because they put their gang creed before their own life? I am not picking on you or singling you out I truly don't understand. "

winghunter-"If you know or they know then why not man up and tell the NPD who did it and walk away a free man? Sounds easy enough to me."
haha wow "man up" "tell" haha wow from your point of view yes i can see how that would be the better move but anybody who has done any time will tell you it will get ugly for them streets or in jail you will never be able to understand this "gang creed" but this all goes back to the lifestyle these young men chose to live its a cat and mouse game cops and robbers just some of those robbers carry around a "snitch blade" it would be good for the investigation to bring in Ricardos friends more robbers with more blades.
Dont worry people these big bad gangmembers will all end up doin time innocent and guilty alike "

When stephen was shot in November why didn't he tell the police who shot him? I'm sure he knows who did it, or who the guy is friends with. Don't blame the Napa Pd for not investigating when The guy who got shot won't open his mouth and help with the investigation. Also I'm sure these guys knew what guys were in the car that drove Ricardo to the fight, why don't they tell the police who else was involved in the fight.
To 49er,
Who are the right people that need to get arrested? You sure seem confident that these guys didn't do it, so you must Know something that the police don't. Why don't you help these guys out and get them off the hook for a crime they didn't commit and tell the police who did it.
I can't wait for this trial to see how these guys are going to prove they are innocent. Detectives investigating a murder for almost a year usually get plenty of evidence to convict peole they arrest. "

If you are so sure that they have the right person now, then why have you not said anything before??????
To "brea" You have heard, wut have you heard? In a case like this you can't just go by hear say, or word of mouth, this is serious and can ruin the lives of these innocent people.
To "tiredofcomplainingnapkins"
I don't know who did it, all I know is that Danny and Jaime are innocent. They both are very loving and kind people. I know that everyone say's they are bad and evil gangmembers, but I know diffrent and these boy's are innocent and the truth will be known!
To "winghunter" I don't know why they won't say anything, can it be because they don't know who did it. If you think about it, when your involved in a big fight like that, involving about 50 people and you hear gunshots..... what's the 1st thing your gonna do????? either get on the ground or start running right? They don't know "

NVR needs to put up the picture of Jaime Pena so that we know what he looks like just in case we see him. No one has the right to take anyone's life and justice needs to be served. "

Treat them as the terrorist that they are. They are all cowards. THAT is why they hide behind their gangs.
Gang member = death penalty.
End of story. "
jonb3333 wrote on Oct 26, 2008 5:28 PM:
Idiots, they are the problem.
No-one wants to admit their family member would do something like this, especially if you are one of them. Might get caught... Maybe gangs are actually BAD!!! I think they should ALL get the death penalty. Start sending a message about what happens when you join a gang of rapist, drug dealing murderers. "
