Napa Sentinel publisher Harry Martin may have run afoul of election laws by failing to report contributions to his campaign for Napa County supervisor.

Martin, a candidate in the race for District 2, missed three consecutive deadlines to file statements documenting his campaign contributions and expenses, according to records from the Napa County Registrar of Voters’ office. He is being investigated by the Fair Political Practices Commission.
Martin is in the November run-off against incumbent Mark Luce, who represents the district including northwest Napa and Yountville.

The last time Martin filed a campaign statement was in March, when he reported $1,755 in donations. Since that time, Martin said he has raised about $900, almost all in donations less than $100 each. Because Martin raised more than $1,000 in March, he is obligated to file a campaign statement for every filing period thereafter, regardless of whether he raised additional funds, according to Napa County Registrar of Voters John Tuteur.
Tuteur said an employee from his office reported Martin to the FPPC earlier this year.

Martin, a former Napa City Council member, said he received a letter from the FPPC on Aug. 20 notifying him that he is under investigation. He has not responded to the letter, he said.
Officials from the FPPC contacted the registrar’s office this Monday to ask if Martin had submitted any new campaign statements, Tuteur said. His office informed the FPPC that Martin had not filed any new statements since the complaint was made, and missed this Monday’s deadline for the most recent filing period.

The FPPC did not comment on the status of the investigation.

Martin said he has documentation for all contributions, but because of personal reasons, he has been unable to find the time to file campaign statements.

“All these files are sitting on one space…” he said. “It just keeps piling up and up.”

“There’s nothing secretive about the filing,” Martin said, adding, “There’s nothing to keep from the public. I mean, there’s nothing to show.”

Martin said he will submit a campaign statement for the latest filing period next week.

Luce change

Luce has raised about $86,000 to date, including $54,500 since July 1, according to a campaign statement.

During the latest filing period, which runs from July 1 to Sept. 30, Luce received $49,230 in monetary contributions.

Donors to Luce’s campaign include:

$500: BPI Company, Napa; Mary Pollock, Sonoma; Michael Honig, Honig Vineyards & Winery, Rutherford; PG&E, San Francisco; Silverado Partners, Napa; Silverado Grapegrowers, Napa; SPP Napa Vineyards, Napa; The Doctor’s Company, Napa; Joseph Peatman, Gasser Foundation, Napa; Yount Mill Vineyards, Oakville; Teaderman Business Park, Napa.

$700: Jack Cakebread/Cakebread Family Trust, Cakebread Cellars, Rutherford.

$1,000: Leslie Rudd Investment Co., Napa; Thomas Futo, Investor, KT Wine Co., Oakville; Andy Beckstoffer, Grapegrower, Beckstoffer Vineyards, St. Helena; Jaeger Family Trust, Napa; Darioush Winery, Napa; Folio Wine Partners, Napa; California Real Estate Political Action Committee, Los Angeles; Volker Eisele, St. Helena.

$1,151: W. Clarke Swanson, Owner, Swanson Vineyards, Oakville.

$1,500: V. Sattui Winery, St. Helena; Nova Group Inc., Napa.

$2,500: Diane Wisley, A. Wilsey Properties Co., San Francisco; Barrel Ten Quarter Circle Inc., Napa; Lenawee Trust, Irvine; Betty Woolls O’Shaughnessy, O’Shaughnessy Vineyards, Oakville; Craig Hall, President, Hall Financial Group, Frisco, Texas; Stagecoach Vineyards, Napa; Warren Winiarski, Napa; C-Line Express, American Canyon; Green Tree Properties, Napa; One True Vine, St. Helena.

Luce also received $5,288 in non-monetary contributions this period: $388 worth of sparkling wine from Schrambsberg Vineyards and $4,900 of in-kind contributions for a fundraising event at Far Niente Winery.

" Harry is too busy to follow the law? That says a lot about his qualifications to be Supervisor. "

" We need Harry in there to mix it up a bit. It's very lopsided when you have just a bunch of "winos" runnin the show, don't you think ?
An employee from Teuter's office ? Give me a break ! The deck is stacked, admit it ! Put Harry in there for a more equitable city government. "

" Winerys and Realtors all seem to love Luce...
just another reason for me to vote for the other guy. "

" I agree with 14obama and 4gnapan...too many from the wine industry are in Luce's camp. This bodes ill, methinks! Too much wine, wine related stuff has ruined Napa. So, I agree w/those who believe the makeup of our representatives needs to be more diverse...I'm in Harry's corner.

As far as reporting donations; I have no doubt that Harry Martin will come through w/the information. "

" 14obama: Yes, let's blame the Election Dept. for doing their job and reporting Martin to the FPPC for violation of Federal campaign reporting laws. After all, it's unreasonable to expect Martin to comply with the law and spend all of 15 minutes to fill out a form and submit it like every other candidate does. He should get special treatment because he's just a poor victim. "

" ok, wine industry bad, the industry that pays for everything in Napa County, the industry that if it didn't exist we'd only see houses for as far as we can see. Harry good, the guy who can't follow the law. Are you guys nuts? Would love to have what you're smoking, must be nice living in fantasy land. "

" What a joke, concerned citizen. The wine industry has ruined Napa??? Are you kidding? What makes Napa different from Vallejo or Fairfield? The wine industry. What has prevented this county from becoming just another bay area bedroom community? The wine industry. Who has poured millions of dollars annually into health and social services programs and donated thousands of bottles of wine to every non profit and school's fundraisers? The wine industry. I think all of you that are so against the wine industry should think about what this city would have become, not what it was. Progress and people were going to come to Napa with or with out the wine industry, it was never going to stay like it was in the "good ole days". Wake up and smell the Cabernet. "

" Well Harry fails at allot of things. Paying his bills are one of them. So no big surprise that he doesn't report his contributions. The family should stop running for anything. "

BKF wrote on Oct 8, 2008 2:57 PM:

" This simply displays Harry Martin's lack of process-oriented thinking. We need our supervisors to be perpetually cognizant of the processes involved in their decision-making. Supervisor Luce does a fantastic job because he pays attention to detail. He is a process-oriented thinker. "

" hmmm247. You are correct. He only runs for office to make money to keep the Sentinel afloat. All the voters have to do is look into the register's archives. "

" Harry Martin is a straight-shooter and hates corruption. Pick up the Sentinal once in a while and you'd be surprised to find out what's really going on around town. It's not like he's banking out with a lot coming in. Did he purposely do anything unlawful or unethical? Not that I can see. It's obvious who the Register supports. This story is not front page worthy, let alone worthy of any page for that matter. Not exactly being unbiased. Nice work NVR. If it turns out that he is a hypocrite and did something unethical, then throw him to the dogs. Until then, there is nothing here. "

Raven wrote on Oct 8, 2008 7:53 PM:

" not so much of a straight shooter that he files required paperwork on time...that shows either a lack of understanding of the basic process or a willing disregard of his need to follow the law... "

kkjp wrote on Oct 8, 2008 8:56 PM:

" hawkins707: You ask, "Did he purposely do anything unlawful or unethical?" The answer is yes. It is unlawful to fail to file Federal campaign reporting forms. Martin has run for office numerous times, and submitted numerous forms (although often late), so he's aware of the process. He places no importance on personally following the law, but is the first to rip other candidates in his rag if he feels they aren't. A hypocritical double standard. "

" Or is this a sly ploy for/from Harry to get publicity in the Napa Valley Register? Will a follow-up article feature his picture in color? "

14obama wrote on Oct 9, 2008 8:58 PM:

" There was hardly any money to report so get off the attack ! You people sound like a bunch of elephants on a rampage to kill all of the mules. Quit the childish behavior for a change! Harry's a good guy so stop being so judgmental ! "

" I tried logging into the Sentinel web page to see what excuses Martin has for not reporting his income and apparently the web page has been "suspended"

I guess Martin didn't pay his bill? "
