Religious discrimination cited in Angwin development debate

Pacific Union College is ratcheting up legal pressure on the county in the debate over the Angwin urban bubble, claiming a form of religious discrimination if the county changes the status quo.

In a letter from the Seventh Day Adventist Church State Council, President and lawyer Alan Reinach said a federal law called the Religious Land Use and Institutionalized Persons Act precludes the county from taking legally safe steps to carve out agricultural land from the Angwin urban bubble.
There are 12 urban bubbles peppered throughout the county, but only two, one in Berryessa Estates and the Angwin bubble, have the county proposing to remove agricultural lands.

The county, PUC and Angwin agricultural preservationists are expected to take on the issue of changing the Angwin urban bubble at a Tuesday joint meeting of the Napa County Board of Supervisors and the Napa County Planning Commission at 9 a.m. at the Lincoln Theater in Yountville.
County Counsel Robert Westmeyer said he would give the county an analysis of the federal law cited by the Adventists.

" Oh brother! Now they want to bully the county and, of course, it's taxpayers who will end out paying litigation fees. This is counter productive and will create a climate of resentment among the people of Napa County. PUC will end out looking like a bunch of greedy bad guys. If they open up this can of worms, trust me, they will be watching every T they cross for years to come. People in Angwin have graciously tolerated Federal mail delivery on Sundays rather than Saturdays, among other things, forever, without complaint. There are people who have been questioned about their faith when renting/purchasing homes in Angwin. Talk about discrimination! And another little secret that's been swept under the rug is their plans to legally sell these tract homes ONLY to people who work in Angwin and some surrounding areas. Ask yourself "who's the biggest employer in Angwin?" I think PUC is attempting to establish a climate of 'us versus them' to gain support from their immediate community. To ALL Angwin residents, Adventist or not, do not fall for this ploy. This tactic will damage more than PUC. "

" Well I hope you're all happy. Now you've got the lawyers involved. "

As if this is the *first* bullying tactic that's been used in this mess. This is just another of many shots fired. "

" I have been watching with much interest this entire situation for the past several years and am not surprised that the leadership in Angwin has pulled the "Litigation Card" and is also mis-using its position as a religious institution to get what it wants.
The position of PUC seems to be, "You are either with us or against us"...if you are against us; if against, then you will be sued.
Somehow I do not think this is the proper usage of Jesus' words in this context.
Once again, the power elite in their religious garb in Angwin who have completely destroyed what PUC was founded for have served notice to the people of Napa. Imagine the tax consequences if these people win a lawsuit.
Simply put, this is not only not right, it is highly unethical and immoral but whoever said that ethics and morals are kept in check when matters of litigation and bullying tactics are used...even with PUC.
I withdraw my support for this project and urge you to do as well. Keep Angwin rural and perhaps relocating PUC to Sacramento is a better idea in the final analysis. This was one of their considerations during tough financial times brought on by a leadership team who is not only inept in their duties but is not even acting within the bounds of a biblical perspective.
Shame on all of you who perpetrated the need for a lawsuit in this debacle. "

" This is tragic and I am very embarrassed for my neighbors PUC.
How poorly the college is being run, the decline in enrolment, using students as pawns in a real estate scam, the attempt at creating tract home sprawl in a place of open, forested beauty....very sad. "

" It's truly sad to see how PUC is handling this. I was a student inside the SDA schools for over 14 years, and it seemed as if there was always something going on that shouldnt have been.

The college up there is desperate for money, and if it means giving them a black eye now, along with a breifcase of cash, they dont mind.

This is truly dissapointing. "

" everybody gets paid by the college to go , if employees, and gets credit, if a student. the store will be closed until 1pm. employees will not be paid unless they go to the veterans home from 9am until the meeting is over. those who start at 7am get paid the extra 2 hours. discrimination? i don't see anyone interfeering with the right to free expression or property rights. we will get an explanation about what the law really entails tomorrow. i would jump to puc's defense right away if i saw actual abuse happening, like if the county wanted to take away the property by eminent domain or something. that is not happening. "

" nope. give it a couple years before you get involved with napa. they are about as corrupt as can get down there. i'm ready to see some bodies drop, but i'd appreciate it if angwin would stay out of it. plumpjack is a good group. do business with them, and stay out of napa. you don't owe them anything puc. you're not their helper, nor do you need to attend their meetings. thanks.. jon toews

" please change the wording on that last one. as in "bodies drop" i meant a "change in" leadership. we shouldn't have county officials and officers of the court taking our money, not showing up to represent us and passing our money around to other attornies. "

" thanks... they shouldn't assume they can keep getting away with this. leave pacific union college out of it. "

PUC Prof wrote on Feb 26, 2008 1:42 PM:

" Well, the first four speakers at today's meeting were members of the 21-member General Plan Update Steering Committee, all relatively independent and impartial volunteers who had donated 2 years of their time to studying the General Plan, and guess who they thought was the victim of SRA's proposal to rezone PUC's land from "planned development" to "institutional" (a zoning category which DOES NOT EXIST anywhere within the county)? They thought private land rights were already heavily restricted by the government and further restrictions on one private land owner was an attack on all. They believed the purpose of government was to protect private land rights, and to protect the minority from the majority. The chairman of the committee quoted Benjamin Franklin as saying something like "Democracy is two wolves and a lamb voting for dinner," and then declared the lamb to be PUC. "

" The urban bubbles were a mess from the get go. Those loosely drawn lines were not intended to be taken literally. Sooner or later the county will hit snags with the other bubbles and it would be wise to address them head on NOW. If there's anything I learned from the meeting today, it's just how indecisive some of our leaders can be. Why can't they agree to make consistent decisions on ALL of the urban bubbles and just put it behind them once and for all? Someone is pulling the religious card out this time. The next card may be an even greater menace. "
