Hearing delayed for driver in crash where woman lost her legs

A preliminary hearing scheduled for tomorrow morning for the driver accused of hitting a Napa woman whose legs were amputated as a result of the crash is delayed until March 14.

Francisco Pacheco, 24, faces charges of DUI and hit-and-run from the Feb. 3 crash where his car struck Lilian Clark, who was behind her doubled-parked vehicle on South Terrace Drive in Napa.
Pacheco fled the scene and was arrested after neighbors followed him from the crash.

He was placed on an Immigration and Customs Enforcement hold at the Napa County Jail. ICE seeks holds on criminal suspects who the agency believes may be in the United States illegally. Such holds may result in deportation.
Pacheco is on probation for a 2007 DUI conviction, and has a misdemeanor DUI case from last year that is pending.

At a court hearing today, the matter was continued because accident reports from the California Highway Patrol had not been completed, according to Napa County Chief Deputy District Attorney John Goold.
Clark's legs were crushed so badly in the crash that doctors had to amputate them above the knee on the evening of the crash.

" If he's in the United States illegally shouldn't they have caught that on the first DUI??? Had they deported him at that time then maybe this mother of two would still have full use of her legs. "

" They wont deprot them. THey will send him to jail where we will have to pay to feed him, and pay for what ever medical needs he may have. "

" Sam, My friends whole family is legal and he is not and every time he goes to jail they deport him. They most of the time will not keep people who are not here legaly. "

" It is time that we enforce our laws concerning illegal immigration. If our country delivered a zero tolerance message to illegal immigrants maybe we could slim down this problem. I say that if you come here illegally and get caught we ship you right back to where you came frome and you lose any chance of ever becoming a citizen in this country. " I've been following this tragic story and, unfortunately, it is an all too common problem. To deport or to jail? That is an ongoing issue here in Nevada as well. As a part of a local study by law enforcement regarding the impact on the court and prison systems by illegal residents the following story was recounted. An illegal was arrested for drunk driving and property damage. After treatment at a local hospital, he was jailed and eventually went before a judge. The judge ordered him deported and he was. Three weeks later the same illegal was before the same judge on similar charges. How frustrating! Something has to be done. This has such a huge fiscal impact on communities and someone needs to come up with a solution soon! "
