Gabriel Francis Hernandez was acting strangely early Friday night according to his neighbors.

Napa Police records show that neighbors told police that Hernandez was jumping on the roof of his home on the 100 block of Broadmoore Drive and eventually fell off.
Then, around 1:58 a.m., Saturday, neighbors reported that a motorcycle was burning at the home. When police arrived, they discovered the motorcycle was completely destroyed and that its registered owner, Hernandez, was nowhere to be found.

Officers later caught up to Hernandez and arrested him on suspicion of the arson of the motorcycle.

" I agree that he was acting strange...but why whould he get arrested for destroying his own property? "

" How can he be arrested for arson of his own property? As long as he didn't try to file a fradulent insurance claim what did he do that was illegle? "

Arson... wrote on Jul 23, 2007 5:19 AM:

" It may not technically be considered arson...but I don't think it'd be a good idea to let people start torching their own vehicles or other forms of property...especially with fire danger so high presently. "

Strange yes, illegal, yes wrote on Jul 23, 2007 10:31 AM:

" It doesnt matter whether its your own property or not, setting it afire is still illegal. You cant burn down your own house and expect the police to say, meh, its his own house, no biggie, we'll let it slide. Its not like that, there are laws against setting things on fire without a permit and a vehicle is one of those things. If ya want it destroyed take it to an auto dismantler, dont burn it in your own yard. "

" Wow...it's hilarious to me that people really aren't aware of what the various laws are. Just because it's your property does not mean you can destor it. "

" Will this arrest lead to some help for this person who was jumping on the roof and setting fire to a motorcycle?? Sometimes an arrest can be an attempt to save someone who is a danger to himself. Sad situation for this guy. "

" I destroy my own property on a daily basis, and that's "illegal"? As usual the drive-by media didn't report al the facts. "
