A federal judge in San Francisco has found the city of American Canyon’s campaign sign law unconstitutional, handing victory to 2006 mayoral candidate Paul Maguire.

Judge Joseph Spero of the U.S. District Court for Northern California on March 1 gave the city 180 days to “address the constitutional defects” of the campaign sign ordinance passed last summer.
Among other restrictions, the city’s law states campaign signs can be displayed no earlier than 90 days before an election and they may not be placed in the public right-of-way.

Maguire said the law violated his free speech rights.
Spero agreed, saying the city improperly applied the law to political signs but not others. He wrote the city “has presented no evidence that justifies treating political campaign signs differently from other types of signs” with the time restriction.

He also found the restriction on placing political signs in the public right-of-way was improper, as it singled out political signs without being applied to commercial or other signs.
American Canyon officials say they plan to ask the court to reconsider the ruling before they go about rewriting the law.

“We are going to seek reconsideration,” said American Canyon City Attorney Bill Ross.

Safety hazard?

According to court records, a campaign sign Maguire had posted at the intersection of Theresa Avenue and Eucalyptus Drive on the east side of Highway 29 was removed by a public works superintendent who believed it was a safety hazard. The city did not notify Maguire before removing the sign.

Maguire, a San Ramon-based real estate owner and former Napa Valley Casino owner who has run for office in American Canyon three times, said he plans to run again in the future, according to court papers.

In an e-mail sent to the Napa Valley Register, Maguire said “I am glad that a federal judge had the wisdom and courage to recognize and announce what I have been saying since September: The American Canyon sign ordinance was a censorship tool adopted by the City Council to inhibit campaigns against incumbents.”

The ordinance was adopted in August; Maguire filed suit in September.

There are no visible campaign signs remaining along the city streets or Highway 29, which is under Caltrans’ jurisdiction.

Caltrans spokesman Keith Wayne said candidates have to obtain a permit 90 days before the election to post a sign on Caltrans property. Candidates also have to take the signs down 10 days after the election.

“A lot of people don’t abide by this rule,” he said. “We don’t condone it.”

As of Jan. 10, the city’s legal fees for the Maguire case totaled about $74,000, according to city records.

" American Canyon is going to seek reconsideration. So it is not over by far. Mr. Maguire continues to cost the city and believed to be because he new he would lose the vote, he would try to keep himself in the news, good or bad attention. Less clutter on our streets is good. I thought he ran for council on our future, no we got it wrong, he wants to run our future. Not gonna happen, he and Ms. Coffey are not in the sphere of Influence with the public, they appear in it for themselves. A new Day and the same old actions, law suit is their only way to get their point across because no one wants to listen to them and look at all it costs this city, how dare they talk about the city spending money wrong, they are clueless with what this city wants.They probably have it wrong on what the city needs too. American Canyon needs to fend off these people from law suits in the name of campaigning. 2008 we can set it straight!!! "

" Am Can needs a new city attorney. He's lost too many crucial suits which "have no merit". As for Maguire and Miller. They didn't abide by the guidelines outlined in the candidate paperwork, sue and win! I love the AMERICAN (CANYON) LEGAL SYSTEM.. "

" Mr. Maguire should think twice on what he does to the city he wants to represent. The advice he is getting sounds like it's for someone else's benfit rather than his or the city's. Three time and no luck at winning-time for him to stop trying. We need the council to step up and get control of the people who take all the money from the city so that we can us it wisely. "

" Cal Trans has taken down signs of those campaigns that they (or someone within that Dept) disagree with while leaving other political signs of those with whom they agree. Of course they don't admit this, but the removal of past signage speaks for itself. "

" this is just another example of the ineptitude of the American Canyon city Government. The list goes on and on. There's the Wal-Mart issue. the city was in such a hurry to get in a big box trash store that they seem to have violated state law. They built a sewage plant with without enough room for expansion, they had developers come in and build houses with no real plan with no schools or parks, until the end. as for Mr. Maguire, he is wasting his money running for city council. he has cost the city so much money in legal fees. that in and of itself is rediculous. He can spend as much as he wants, he will never get elected. "

" I find the negative comments towards Mr. Maguire and Ms. Coffey very interesting. Maybe some of you don't realize that the Court has agreed with both of these individuals in both cases. So why exactly are they being made out to be the bad guys? Due to incompetant legal advise WalMart was built and a sign ordinance passed. Let's put the blame where it belongs. "
