Kidnapping charge in north Napa case
By MARSHA DORGAN, Register Staff Writer
Roberto Gonzalez had his heart set on returning to Mexico. But instead, he could be having his mail delivered to state prison for the rest of his life.
On Friday, Gonzalez was held to answer by Napa Superior Court Judge Stephen Kroyer on felony charges including kidnapping for extortion, which carries punishment of life in state prison.
The possible life term is a big price to pay, considering Gonzalez ended up with nothing after entering Raymond Windle's home in north Napa on Jan. 24.
Police say Gonzalez took clothes and food from Windle's residence. After Windle came home, ordered Windle to take him to the bank and withdraw cash.
At Gonzalez's preliminary hearing on Friday, Kroyer ruled that Gonzalez must answer to charges of robbery, burglary, attempted kidnapping and kidnapping for extortion.
Windle, 68, testified that he returned home and parked his pickup in his carport on Redwood Road. When he entered his house, he saw mud on the floor.
"I thought my son came down to my house," said Windle. "I called his name, but he didn't answer. When I entered the dining room, I saw a box of paperwork had been gone through. I also saw a duffle bag and suitcase." Windle also said he noticed someone had helped himself to tri-tip, pizza and sodas from his refrigerator.
Windle testified a man came up behind him and said, "Don't make a move. I wouldn't want to see you get hurt."
Windle said the man was wearing a yellow rubber glove on one hand and kept his other hand in his pocket. "He kept rattling his hand in his pocket. I didn't know if he had a gun or a knife in his pocket," he said.
Windle told the court the intruder kept saying that his children wouldn't want to see him get hurt. "I kept asking him, 'What do you want?'"
Gonzalez said he needed money to go to Mexico, Windle said. "He told me not to do anything stupid, and I told him let's get this thing over with."
Windle testified he picked up the suitcase and duffle bag and went outside to his truck. Gonzalez followed.
"I threw the bags inside the back of my truck and ran as fast as I could to my neighbor's house. Thank goodness his door wasn't locked. I used his phone and called 911," he said. "I was pretty scared."
Gonzalez was arrested a short time later a few blocks from Gonzalez's home. About four houses away, officers found the suitcase and duffle bag.
Inside the suitcase, officers found clothing belonging to Windle. "He took my coat, pants, shoes and toiletries. He even took my toothbrush," Windle said. The duffle bag also contained items belonging to Gonzalez, including his identification.
Gonzalez is scheduled to be arraigned on March 13.
