$10 million bail in Dry Creek murder

A Fairfield man accused of killing a Napa mother of four made his first court appearance Tuesday afternoon.
Onesimo Olmedo Garcia, 30, was arraigned for the first degree murder of Sandra Isabel Hernandez, 31, on Sunday afternoon.
Hernandez, who was raised in Napa, leaves behind four children, ages 2, 4, 6 and 13, according to a family friend.
The victim, who was shot to death, knew Garcia, sheriff's Lt. Jean Donaldson said.
Garcia was arrested the same day of the shooting at a Fairfield home he shares with his brother and sister-in-law. He is on felony probation for domestic violence, and the victim of the domestic violence was Hernandez.
At Tuesday's arraignment, Napa County Superior Court Judge Stephen Kroyer also held Garcia to answer for two counts of violation of probation. His bail was set at $10 million.
Sheriff's deputies first responded to report of gunshots at around 5 p.m., Sunday, at a home in the 6200 block of Dry Creek Road, where the victim rented a room. Another woman who lives in the house heard gunshots and found the victim, Donaldson said. "She did not witness the shooting."
When deputies arrived, Garcia had left, driving through a steel fence in his attempt to flee from the residence, District Attorney Gary Lieberstein said.
Donaldson said deputies were able to track down the victim's next of kin, who told them Garcia had been with the victim the day she died. "We were able to get his address and take him into custody," he said.
Donaldson said Garcia was not armed when he was arrested. "We found weapons in the Dry Creek Road house, but at this time we do not know if any of them are the murder weapon."
At Garcia's arraignment, Lieberstein argued for no bail on the murder charge, calling Garcia a flight risk.
"He is not a citizen of the county or the country. He is not employed," Lieberstein said. If found guilty of murder and felony violation of probation, Garcia could be facing 50 years to life.
Defense attorney Laura Lamb said any bail above $100,000 would be unreasonable.
"Mr. Garcia has lived in Napa County for 13 years and worked at an auto body shop in Vallejo for two years," Lamb said.
Judge Kroyer set the bail at $10 million, stating, "This is a serious offense and he has a prior criminal record. There is a high likelihood he would not appear back in court if he is given his freedom. The punishment for this crime is huge and would be a reason for a person to flee."
Garcia's Napa County criminal record goes back to 1996, when he was convicted of petty theft. Since then, he has been convicted of drug charges, using a deceptive government identification, domestic violence, driving under the influence and several violations of probation.
An autopsy was performed on the victim Tuesday. Detectives are tight-lipped about the investigation. Donaldson said that drugs may have played a role in the shooting. He declined to say where and how many times Hernandez was shot.
The sheriff's department is asking for the public's help in finding the car they believe Garcia used to leave the scene. It is described as a dark green or black Lexus with a license plate number of 4HEZ087 or 5LKM551. The Lexus has front-end damage.

Garcia is scheduled to appear in court Thursday to set a date for a preliminary hearing.
